As the pandemic continues with no clear resolution on the horizon, businesses must continue to revamp and reinvent their day-to-day operations to comply not only with a wide variety of new regulations, but also legal implications from existing laws and regulations. On Saturday, Aug. 8, 2020, President Donald Trump signed four executive orders (EO) to defer payroll taxes, set up an assistance program for lost wages to supplement unemployment benefits, extend the federal moratorium on evictions and defer student loan payments.
Brownstein’s National Tax Policy team prepared an analysis focused on the two tax-related EOs on Aug. 10. Click here to view key updates related to the implementation of the payroll tax deferral and the Lost Wage Assistance (LWA) program.

President Trump’s Aug. 8 Tax Executive Orders
Note: The President’s Executive Order on deferral of payroll tax is causing a number of questions regarding compliance options and downstream effects. Brownstein’s tax policy experts created the attached the pdf with initial guidance and issue spotting. Employers will have to provide notices to their employees and will need guidance from employment/labor lawyers to makes sure those notices are appropriate.
