The FCC Proposes Robocall Mitigation Scorecard

The FCC has issued a public notice seeking comment on whether to establish a robocall mitigation provider scorecard to help consumers choose providers that could better protect them from illegal calls and to incentivize providers to take further mitigation steps. The proposal can be found here. The FCC, which would periodically issue the scorecard, emphasizes that the scorecard would not be an indication of compliance with robocall mitigation rules, nor would it be comprehensive. Rather it would provide metrics on mitigation efforts and mitigation success.

The notice proposes issuing scorecards for all providers that serve retail customers, but not wholesale providers. It seeks comment on that proposal as well as on the sources of data to use to create scores. Potential data sources could the robocall mitigation database filings, provider-offered consumer tools or services, enforcement and complaint data and industry sources such as the Traceback Group.

The FCC proposes metrics based on conduct and outcome. Conduct-based metrics could include blocking and labeling practices, traceback responses, and STIR/SHAKEN attestations. Outcome-based metrics could include consumer complaints; number and/or percentage of calls blocked, including false positives; the number of illegal calls received by the provider’s customers; and trend data.

Finally, the notice seeks comment on the methodology to collect and to present the scorecard to consumers.
