DC Circuit decision in traffic pumping case

June 9, 2013 – The DC Circuit today upheld the FCC decision that CLECs may not rely on tariffs to charge long distance carriers for access to CLECs’ non-paying customers.  The issue arose in response to a tariff filed by Northern Valley, a CLEC in South Dakota, as part of a traffic pumping arrangement for conference calling services.
This is a win against the traffic pumpers.  We are not required to pay tariff charges for terminating CLECs with non-paying customers (e.g the free conferencing call companies).
